Preamble<\/strong><\/h4>\n

The Contracting States,<\/p>\n

Desiring<\/strong>,<\/i>\u00a0in conformity with the\u00a0Charter of the United Nations<\/span>, to promote\u00a0universal<\/span>\u00a0respect for, and\u00a0observance<\/span>\u00a0of,\u00a0human rights<\/span>\u00a0and\u00a0fundamental freedoms<\/span>\u00a0for all, without distinction as to\u00a0race<\/span>,\u00a0sex<\/span>,\u00a0language<\/span>\u00a0or\u00a0religion<\/span>,<\/p>\n

Recalling\u00a0<\/i><\/strong>that article 16 of the\u00a0Universal Declaration of Human Rights<\/span>\u00a0states<\/span>\u00a0that:<\/p>\n

(1)\u00a0Men<\/span>\u00a0and\u00a0women<\/span>\u00a0of full age, without any\u00a0limitation<\/span>\u00a0due to\u00a0race<\/span>,\u00a0nationality<\/span>\u00a0or\u00a0religion<\/span>, have the\u00a0right to marry<\/span>\u00a0and to found a\u00a0family<\/span>. They are entitled to\u00a0equal rights<\/span>\u00a0as to\u00a0marriage<\/span>, during\u00a0marriage<\/span>\u00a0and at its\u00a0dissolution<\/span>.<\/p>\n

(2)\u00a0Marriage<\/span>\u00a0shall be entered into only with the\u00a0free<\/span>\u00a0and full\u00a0consent <\/span>of the intending\u00a0spouses<\/span>,<\/p>\n

Recalling<\/strong> further<\/i>\u00a0that the\u00a0General Assembly of the United Nations <\/span>declared<\/span>, by resolution 843 (IX) of 17 December 1954, that certain\u00a0customs<\/span>, ancient\u00a0laws<\/span>\u00a0and practices relating to\u00a0marriage<\/span>\u00a0and the\u00a0family<\/span>\u00a0were inconsistent with the\u00a0principles<\/span>\u00a0set forth in the\u00a0Charter of the United Nations<\/span>\u00a0and in the\u00a0Universal Declaration of Human Rights<\/span>,<\/p>\n

Reaffirming<\/i>\u00a0<\/strong>that all\u00a0States<\/span>, including those which have or assume responsibility for the administration of\u00a0Non-Self-Governing<\/span>\u00a0and\u00a0Trust Territories<\/span>\u00a0until their achievement of\u00a0independence<\/span>, should take all appropriate measures with a view to abolishing such\u00a0customs<\/span>, ancient\u00a0laws<\/span>\u00a0and practices by ensuring, inter alia, complete\u00a0freedom<\/span>\u00a0in the choice of a\u00a0spouse<\/span>,\u00a0eliminating<\/span>\u00a0completely\u00a0child <\/span>marriages<\/span>\u00a0and the\u00a0betrothal<\/span>\u00a0of young\u00a0girls<\/span>\u00a0before the age of puberty, establishing appropriate\u00a0penalties<\/span>\u00a0where necessary and establishing a civil or other\u00a0register<\/span>\u00a0in which all\u00a0marriages<\/span>\u00a0will be recorded,<\/p>\n

Hereby agree<\/i>\u00a0as hereinafter provided:<\/p>\n

Article 1<\/strong><\/em><\/span><\/p>\n

\n

1. No\u00a0marriage<\/span>\u00a0shall be legally entered into without the full and\u00a0free consent<\/span>\u00a0of both parties, such\u00a0consent<\/span>\u00a0to be expressed by them in person after due publicity and in the\u00a0presence<\/span>\u00a0of the\u00a0authority <\/span>competent to solemnize the\u00a0marriage<\/span>\u00a0and of\u00a0witnesses<\/span>, as prescribed by\u00a0law<\/span>.<\/p>\n

2. Notwithstanding anything in paragraph 1 above, it shall not be necessary for one of the parties to be present when the competent\u00a0authority<\/span>\u00a0is satisfied that the circumstances are\u00a0exceptional<\/span>\u00a0and that the party has, before a competent\u00a0authority<\/span>\u00a0and in such manner as may be prescribed by\u00a0law<\/span>, expressed and not withdrawn\u00a0consent<\/span>.<\/p>\n<\/div>\n

Article 2<\/strong><\/em><\/span><\/p>\n

\n

States Parties<\/span>\u00a0to the present\u00a0Convention<\/span>\u00a0shall take\u00a0legislative<\/span>\u00a0action to specify a\u00a0minimum age<\/span>\u00a0for\u00a0marriage<\/span>. No\u00a0marriage<\/span>\u00a0shall be legally entered into by any person under this age, except where a competent\u00a0authority<\/span>\u00a0has granted a dispensation as to age, for serious reasons, in the\u00a0interest<\/span>\u00a0of the intending\u00a0spouses<\/span><\/p>\n<\/div>\n

Article 3<\/strong><\/em><\/span><\/p>\n

\n

All\u00a0marriages<\/span>\u00a0shall be\u00a0registered<\/span>\u00a0in an appropriate\u00a0official<\/span>\u00a0register <\/span>by the competent\u00a0authority<\/span>.<\/p>\n<\/div>\n

Article 4<\/strong><\/em><\/span><\/p>\n

\n

1. The present\u00a0Convention<\/span>\u00a0shall, until 31 December 1963, be open for\u00a0signature<\/span>\u00a0on behalf of all\u00a0States<\/span>\u00a0Members<\/span>\u00a0of the\u00a0United Nations <\/span>or\u00a0members<\/span>\u00a0of any of the specialized agencies, and of any other\u00a0State<\/span>\u00a0invited by the\u00a0General Assembly of the United Nations<\/span>\u00a0to become a Party to the\u00a0Convention<\/span>.<\/p>\n

2. The present\u00a0Convention<\/span>\u00a0is\u00a0subject<\/span>\u00a0to\u00a0ratification<\/span>. The\u00a0instruments of ratification<\/span>\u00a0shall be deposited with the\u00a0Secretary-General of the United Nations<\/span>.<\/p>\n<\/div>\n

Article 5<\/strong><\/em><\/span><\/p>\n

\n

1. The present\u00a0Convention<\/span>\u00a0shall be open for accession to all\u00a0States <\/span>referred to in article\u00a04<\/span>, paragraph 1.<\/p>\n

2. Accession shall be effected by the deposit of an\u00a0instrument of accession<\/span>\u00a0with the\u00a0Secretary-General of the United Nations<\/span>.<\/p>\n<\/div>\n

Article 6<\/strong><\/em><\/span><\/p>\n

\n

1. The present\u00a0Convention<\/span>\u00a0shall come into\u00a0force<\/span>\u00a0on the ninetieth day following the date of deposit of the eighth\u00a0instrument of ratification <\/span>or accession.<\/p>\n

2. For each\u00a0State<\/span>\u00a0ratifying<\/span>\u00a0or acceding to the\u00a0Convention<\/span>\u00a0after the deposit of the eighth\u00a0instrument of ratification<\/span>\u00a0or accession, the\u00a0Convention<\/span>\u00a0shall\u00a0enter into force<\/span>\u00a0on the ninetieth day after deposit by such\u00a0State<\/span>\u00a0of its\u00a0instrument of ratification<\/span>\u00a0or accession.<\/p>\n<\/div>\n

Article 7<\/strong><\/em><\/span><\/p>\n

\n

1. Any Contracting\u00a0State<\/span>\u00a0may\u00a0denounce<\/span>\u00a0the present\u00a0Convention<\/span>\u00a0by written notification to the\u00a0Secretary-General of the United Nations<\/span>.\u00a0Denunciation<\/span>\u00a0shall take effect one\u00a0year<\/span>\u00a0after the\u00a0date of receipt<\/span>\u00a0of the notification by the Secretary-General.<\/p>\n

2. The present\u00a0Convention<\/span>\u00a0shall cease to be in\u00a0force<\/span>\u00a0as from the date when the\u00a0denunciation<\/span>\u00a0which reduces the\u00a0number<\/span>\u00a0of Parties to less than eight becomes effective.<\/p>\n<\/div>\n

Article 8<\/strong><\/em><\/span><\/p>\n

\n

Any\u00a0dispute<\/span>\u00a0which may arise between any two or more Contracting\u00a0States<\/span>\u00a0concerning the\u00a0interpretation<\/span>\u00a0or application of the present\u00a0Convention<\/span>\u00a0which is not settled by\u00a0negotiation<\/span>\u00a0shall, at the request of all the parties to the\u00a0dispute<\/span>, be referred to the\u00a0International Court of Justice<\/span>\u00a0for decision, unless the parties agree to another mode of\u00a0settlement<\/span>.<\/p>\n<\/div>\n

Article 9<\/strong><\/em><\/span><\/p>\n

\n

The\u00a0Secretary-General of the United Nations<\/span>\u00a0shall notify all\u00a0States <\/span>Members<\/span>\u00a0of the\u00a0United Nations<\/span>\u00a0and the non-member\u00a0States <\/span>contemplated in article\u00a04<\/span>, paragraph 1, of the present\u00a0Convention<\/span>\u00a0of the following:<\/p>\n

(a)\u00a0Signatures<\/span>\u00a0and\u00a0instruments of ratification<\/span>\u00a0received in accordance with article\u00a04<\/span>;<\/p>\n

(b)\u00a0Instruments of accession<\/span>\u00a0received in accordance with article\u00a05<\/span>;<\/p>\n

(c) The date upon which the\u00a0Convention<\/span>\u00a0enters into\u00a0force<\/span>\u00a0in accordance with article\u00a06<\/span>;<\/p>\n

(d)\u00a0Notifications of denunciation<\/span>\u00a0received in accordance with article\u00a07<\/span>, paragraph l;<\/p>\n

(e) Abrogation in accordance with article\u00a07<\/span>, paragraph 2.<\/p>\n<\/div>\n

Article 10<\/strong><\/em><\/span><\/p>\n

\n

1. The present\u00a0Convention<\/span>, of which the\u00a0Chinese<\/span>,\u00a0English<\/span>,\u00a0French<\/span>,\u00a0Russian<\/span>\u00a0and\u00a0Spanish<\/span>\u00a0texts shall be\u00a0equally<\/span>\u00a0authentic<\/span>, shall be deposited in the\u00a0archives<\/span>\u00a0of the\u00a0United Nations<\/span>.<\/p>\n

2. The\u00a0Secretary-General of the United Nations<\/span>\u00a0shall transmit a\u00a0certified<\/span>\u00a0copy<\/span>\u00a0of the\u00a0Convention<\/span>\u00a0to all\u00a0States<\/span>\u00a0Members<\/span>\u00a0of the\u00a0United Nations<\/span>\u00a0and to the non-member\u00a0States<\/span>\u00a0contemplated in article\u00a04<\/span>, paragraph 1.<\/p>\n<\/div>\n

IN FAITH WHEREOF<\/strong> the undersigned, being authorized, have Signed,
\non behalf of their respective Governments, the present Convention which
\nwas opened for signature at the Head quarters of the United Nations, New York,
\non the tenth day of December, one thousand nine hundred and sixty-two.<\/p>\n
